Elias J. TV files petition to cancel contract with talent manager

“No comment” was the response of Elias Lintucan Jr., better known by the screen name Elias J. TV, when asked about the rumored intimate relationship between him and his manager Beverly Pumicpic Labadlabad.
Elias said this when he appeared before reporters at a press conference called by his legal counsel, Atty. Israelito Torreon, on Thursday, August 7, 2025.
This is after Elias and the members of his Elias J. TV band filed petitions with the Regional Trial Court of Kidapawan City, Cotabato to nullify their contract with Beverly.

Torreon is Elias’ lawyer.
The public is familiar with him because he is the legal counsel of controversial Kingdom of Jesus Christ leader Pastor Apollo Quiboloy.
Torreon also led the filing of a petition with the Supreme Court for certiorari and prohibition aimed at questioning the validity of the impeachment complaint approved by the House against Vice-President Sara Duterte.
GROUNDS FOR PETITION TO CANCEL MANAGEMENT CONRACT
Torreon explained to members of the media the root cause of Elias and his bandmates’ decision to seek court assistance to nullify their contract with Beverly.
The lawyer said: “Essentially our stand is that the contract is void, not only voidable, meaning the contract signed by Elias is invalid because that contract was without consideration.
“When I say walang consideration, at the time of the signing of the contract in April 4, 2025, in Dumaguete City, the same Elias Lintucan or Elias J. TV band was already well known, not only in the country but abroad as well.

“It was already a singing sensation, the band itself is widely known.
“While the manager, Beverly Pumicpic Labadlabad, had no history whatsoever of managing any talent. And, as a matter of fact, in her previous declarations, she admitted that she had no history of managing artists.
“So, therefore, there is no claim that she had any contribution at all in so far as the popularity of Elias J. TV band or Elias himself.
“When you sign a contract with a very well-known artist, there are three elements— cause, object, consideration.
“Was there a cause? Yes.
“Was there an object? Yes.
“But there was no consideration.
“So, therefore, we feel that there was no contract at all since one of the essential elements is missing.
“So, therefore, it is void.
ALLEGED DECEPTION
According to Atty. Torreon, there was deception when Beverly signed a contract with Elias and his bandmates.

Beverly allegedly convinced Elias that he was very rich, had many connections, and that his only intention was to help.
“Second, it was likewise, there was also dolo causante ,” Torreon said, referring to the legal term that means a serious deception to get a party to sign a contract.
“There is fraud in the causation of the contract, which means that at the time when the contract was signed, there was fraud employed by Beverly, such that she made Elias believe that she was very rich or she is very rich, that she had all connections, and that her only intention is to help.
“He said all he had in mind was helping Elias and that he had no intention of making money from it.”
“But things turned out differently. Because of the contract signed, Elias was in a hurry at the time, and the band also, had to respect the contracts that they had concerning the show that they had to be present.”

According to Elias’ lawyer, Beverly showed the singer the contract without explanation. Elias also did not have the opportunity to ask questions and consult a lawyer.
“It was shown to him without explanation. Elias had no chance to question the details, and he had no chance to get a lawyer to consult.”
“Signed, the consideration is blank as to how much Beverly Labadlabad’s share is.”
“Why? Because when it was shown again, because he [Elias] was not given a copy of the contract, the thirty percent [commission] was already indicated. But the basis of the 30 percent, it was blank.”
“Then whatever corporation he sets up later, even if he doesn’t have a contribution, 30 percent is still his and he can buy it for PHP50 per share.”
Pagpapatuloy ni Torreon: “There are so many grounds that we cited in the complaint, such that we feel that it is null and void at the very beginning and it should be stopped.
“Even the contract, when you read it, where did they sign? Dumaguete City. Where is the notarization? In Quezon City.”

“I asked Elias, ‘Do you know the lawyer who signed?’ He didn’t.
“Is that possible under notarial law when you notarize a contract without seeing the person who signed it? That’s not possible.”
ALLEGED THREATS
Another allegation from Elias J. TV’s camp is that there is intimidation taking place at Beverly Pumicpic Labadlabad’s camp.
Torreon said: “Then they said they were monitoring, they were going to keep an eye on me. They said they were going to file a cyber libel case. Let’s get it on! Watch over me.
“We were actually forced to file because we were hoping something would intervene, but they even conducted a press conference last night. The words were harsh and they even intimidated us.”
The press conference Torreon is referring to is Beverly’s appearance to the entertainment press at the Century Park Hotel in Malate, Manila, on Wednesday, August 6.
Together with his legal counsel, Atty. Ferdinand Topacio, the talent manager announced that he will file a complaint for estafa and breach of contract against Elias and his bandmates next week.

But Elias’ camp had already filed a petition to nullify their management contract with Beverly.
According to Atty. Torreon: “This is from North Cotabato. I am from Davao del Sur. Fear is what they want.

“We had nothing to fear, we just filed a case immediately after, of course, sending a demand letter to Beverly.”
“He [Elias] hired a manager. It’s almost like he’s a mother or something, because even his personal life is getting involved.”
“And also to the members [of the band], if they cannot attend a meeting without proper notice, or if there is one, they have the right justification, they will be fined immediately. How much? Fifty thousand [pesos]!
“Read the contract they made you sign, it wasn’t read carefully, it doesn’t say anything about you being absent from a meeting, the fine is fifty thousand.”
“I think his fine is even higher than a dog biting another person. This is severe!”
“Then if someone expresses an opinion, a memorandum will be issued immediately. So, that won’t work.”
“If you have a little power, don’t exercise it in such a way that you will also, probably in the eyes of other people, appear to have power.

“Exercise it in such a way as not to hurt also other people.”
Atty. Torreon apologized to the members of the media present for his heightened emotions.
This was because the lawyers of the other camp allegedly insulted him.
He said: “Excuse me, I’m a little angry.
“I’m calm, right, but when our friends there from Manila, our lawyer friends there, insult me, well, Atty. Torreon fights back.
“I’m respectful, but if you insult me, I’ll insult you back.
“I am a little bit hyped up, different from a full Atty. Torreon, because I was insulted last night.
“I don’t feel well so please be patient.”
BEVERLY DENIES INTIMATE RELATIONSHIP WITH ELIAS
A day before the press conference called by Elias’ camp, Beverly and her legal counsel, Atty. Ferdinand Topacio, spoke about the legal action they will take against the reggae artist who is very popular in the Visayas and Mindanao.

Here, he answered all the issues that caused a rift in his talent-manager relationship with Elias.
During the press conference, Beverly denied the speculation that she and Elias were in a relationship but did not deny that the singer’s live-in partner was jealous of her.
Beverly also responded to the accusations made by Elias’ ardent fans that she is a transgender woman.
Part of her statement: “Here in the Philippines, you can’t really change your gender, so Miss Beverly is a woman.
“I’m already married and I’m not pregnant. I dream of getting pregnant, of course, with my husband, but not with someone else.”
“So of course, I don’t want to ruin the relationship.”
“So, my bashers, I don’t think about that anymore. I just thank them.”
“Even though I didn’t pay them, they interfered in my life. They took care of me.”
“So, thank you very much.”
